Your privacy is important to KWEV LLC (“KWEV”, “our”, “us” or “we”) as is your trust in our products and services. This Privacy Policy describes how KWEV, together with our affiliates and subsidiaries, handles personal information in connection with our products, services, websites, applications, KWEV network, KWEV account (if you have a registered account) and our electric vehicle charging stations (collectively, the “Services”), and when you otherwise interact with us.

Please read this Policy carefully to understand how we handle your information. We may supply a different privacy policy in relation to some of our Services, and that policy will apply to any information provided to or collected by us pursuant to those Services.  By using or otherwise accessing the Service, you agree to this Policy. If you do not agree to this Policy, please do not access or use the Service.

Information We Collect

The information we learn from users helps us not only provide the Service but also to personalize and continually improve each user’s experience with the Service. Here are the types of information we may gather:

Information Collected Directly From You

The types of information that KWEV may collect includes, but is not limited to, the following categories listed below.  We may receive this information when it is provided directly to us by you (including through interaction with our Services), our business partners which in some cases can be your employer and/or companies who own or operate charging stations (“Site Hosts”) and certain trusted service providers we work with.  We may also obtain information from other sources such as publicly available sources.

To provide you with an efficient customer experience, we may collect your information through your use of various technologies such as QR codes or RFIDs. We may combine information that we receive from the various sources described above for the purposes identified in this Privacy Policy.  Depending upon your use of our Services, we may collect some or all of the following information:

Contact Information; such as your name, phone number, postal address and email address.

Account and Authentication Information; such as usernames and passwords;

Payment Information (through our payment processor); such as your credit card number, CVV code and expiration date for payment processing;

  • Vehicle Information; such as license plate, make, model, year, color etc.;
  • Charging Network Data: When you use the KWEV Network, we may collect information such as, charging session date, start time, end time, duration, identification number, energy dispensed, charging port identification number, total fees associated with each charging session, pricing policy applied, RFID Card Identification Number, power cycle patterns, current, and voltage.
  • Charging Station Data: If you are a Site Host, or own, or operate a charging station for use on the KWEV network commercially, we may collect certain information from you as a Site Host, such as contact details and the Site Host’s affiliation or association to a company account, we may also collect session and scheduling data, information relating to the WIFI network you connect to the charging station, geolocation of the charging station, and other data you input into the home charging station. If you own or operate a charging station for home use, we may collect session and scheduling data, information relating to the WIFI network you connect to the charging station, geolocation of the charging station, and other data you input into the home charging station.
  • User Content: The Service may allow you to upload content, such as videos, images and photos, reviews and communications;
  • Demographic Information; such as your age, gender and date of birth, for example, to tailor our Services to you, for age verification and to make our communications to you more relevant; and
  • Chat Information; for example, when you use chat feature to connect with us.
  • You can choose not to provide us with any or all of the information we specify or request, but then you may not be able to register with us or to take advantage of some or all of our Services.

Information Collected From You Automatically When You Use the Service

Like many other websites and/or applications, we also collect information through cookies and other automated means when you use our Service. Information of this sort includes without limitation the following categories:

Device/Usage Information. We and our third-party service providers may use cookies, web beacons, and other tracking technologies to collect and store information about your use of the Service. As described further below, we may collect and analyze information including, but not limited to:  IP address, date and day of access request, pages viewed, time zone, the time spent on each page of our Website or App page, links you have clicked on our Website, the page you visit before and after you come to our Website, browser type, operating system, language, advertising identification number and vendor identifier, usage data including information on how you navigate the Service and version of browser software.

Location Information. When you use the Service, we may collect general location information (such as IP address). If you install our App, we may ask you to grant us access to your mobile device’s geolocation data. If you grant such permission, we may collect information about your precise geolocation, and we may use that information to improve the Service, including providing you with location-based features (e.g., for identification of charging stations available near you). If you access the Service through a mobile device and you do not want your device to provide us with location-tracking information, you can disable the GPS or other location-tracking functions on your device, provided your device allows you to do this. See your device manufacturer’s instructions for further details. If you disable certain functions, you may be unable to use certain parts of the Service.

Cookies and Other Technologies. We use cookies and similar technologies including web beacons, embedded scripts, pixels and e-tags (together referred to as “cookies”, unless otherwise stated) to provide users an efficient user experience in using the Website. A cookie is a small data file that is placed on your computer or mobile device by your web browser. It is a tool that stores information about website visits, recognizes you and your preferences each time you visit the Website, optimizes website functionality, and enables us to provide the Service. Some parts of the Website use cookies to track user traffic patterns.

How Can I Control cookies?

Google Analytics (More information) We use Google Analytics, an internet analytics service provided by Google, Inc. (“Google“). Google’s cookies allow us analyze use of the Platform by telling us which pages our users are viewing, which ones are most popular, what time of day our Platform are visited, if users have previously visited our Platform, from which website users are redirected to our Platform were and the like. Interest Based Advertising:  The third-party advertisers, ad agencies and other service providers with which we work may be members of the Network Advertising Initiative and the Digital Advertising Alliance Self-Regulatory Program for Online Behavioral Advertising. To opt out of interest-based advertising from the participating companies, please visit AboutAds.info for laptops and NAI Mobile Choices or AppChoices for mobile devices. Note that opting out through these channels does not mean you will no longer see ads and is specific to the device and browser you are using. You may still receive other types of ads from these companies, and any type of ad from nonparticipating companies.

 

Aggregate And Deidentified Information

We may also collect, use and share aggregate and/or deidentified information that does not identify you as permitted by applicable laws. For example, we may collect, analyze and share statistical information about the use of our websites, apps and charging stations including data on usage traffic, usage patterns, user numbers, sales and other information in order to measure and improve our Services.

Do-Not-Track

Your browser or device may include “Do-Not-Track” settings or functionality. Currently, our systems do not recognize browser “Do-Not-Track” requests. The information collection and disclosure practices, and the choices that we provide to users, will continue to operate as described in this Privacy Policy, whether or not a Do-Not-Track signal is received.

How We Use Information

We may use the information we collect about you in the following situations:

·      To manage and administer your account if you have an account with us, including to distinguish between multiple vehicles or users under a single account, and for information regarding charging sessions (e.g., duration, energy consumption, station owner and station data);

·      To provide customer service and communicate with you about the Service;

·      To create de-identified and aggregate information;

·      For troubleshooting and quality assurance purposes;

·      To process payments;

·      For marketing, surveys, research and analytics;

·      To develop new products and Services;

·      To protect the rights and property of KWEV, our users, and others;

·      To detect, prevent, and respond to fraud, abuse, and security issues;

·      To comply with legal, regulatory or contractual requirements, and

·      To carry out any other purpose described to you at the time the information was collected.

Communications

Communications with you in connection with these uses may be via mail, telephone, e-mail, text message, in app messages, social media and other electronic messages.  We may send you text messages using an automated telephone dialing system to the mobile phone number you have provided if you have opted into receive text messages. Opting into receive text messages is not a requirement to buy products or services from KWEV, and message and data rates may apply.  See “Choices” below to learn how to manage your communication preferences.

How We Share Information

We may share the information we collect about you in the following circumstances:

·      Within KWEV and our future parents, affiliates, subsidiaries and other companies under common control and ownership;

·      With our trusted services providers who work on our behalf;

·      With our business partners;

·      With your consent, including if you intentionally interact with third-parties on through our Services; for example, when you use our social media features to provide information to KWEV users about our Service or when you direct us to share information with third parties such as utility companies;

·      With our distributors, resellers, channel partners, charging station owners, or authorized third parties including third-party network providers, utilities or their respective employees, freelancers, and consultants to help us provide our Service to you;

·      With Site Hosts when you connect with a charging station owned, operated or hosted by a Site Host;

·      In connection with the sale, transfer or financing of a significant part of KWEV business or its assets;

·      When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud or respond to a law enforcement request; and

·      As required by law, such as in conjunction with a subpoena, government inquiry, litigation, dispute resolution or similar legal process.

Data Security

We use reasonable physical, technical, and administrative safeguards to protect personal information within our organization. We want you to feel confident using the Services, however no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account with us has been compromised), please immediately contact us at privacy@kwev.io.  You are responsible for maintaining the confidentiality of your Services access information and password and for restricting access to your device, and you agree to accept responsibility for all activities that occur under your password.

Your Choices

You can make a request to access and change your personal information we may store by contacting us via email at privacy@kwev.io.  To further protect privacy, these requests may be subject to identity verification.

If you would like to update your preferences, or opt out of marketing communications from us, you may do so at any time by contacting us at privacy@kwev.io or by following the opt out instructions in the marketing communications.  Please note that we will honor your marketing opt-out preferences, but we may continue to send transactional communications related to the Services.

We may send you push notifications through our mobile application. You may at any time change your preferences from receiving these types of communications by changing the settings on your mobile device. We may also collect location-based information if you use our mobile applications. You may update this by changing the settings on your mobile device. You may stop or restrict the placement of Technologies on your device or remove them by adjusting your preferences as your browser or device permits.

The online advertising industry also provides websites from which you may opt out of receiving targeted ads from data partners and other advertising partners that participate in self-regulatory programs. To separately make choices for mobile apps on a mobile device, you can download DAA’s AppChoices application from your device’s app store. Data Retention

We retain your personal information as long as we have an ongoing legitimate business need to do so for example to provide services or products to you, or as required or permitted by applicable laws, such as tax and accounting laws.

Third Party Services and Links to Other Websites

Our websites and apps may contain links to other websites, many of which have their own privacy policies. Be sure to review the privacy policy on any site you are visiting or providing information to. This Policy does not apply to the practices of those third-party plug-ins, exchanges, networks or websites that KWEV has a relationship with or other companies or individuals that KWEV does not own, employ, manage or control.

 

Children’s privacy

Our Services are not intended for children under 13 years of age, or the equivalent age as specified by law in your jurisdiction, and we do not knowingly collect personal information from children under 13.

 

International Data Transfers

In order to provide our Services, we may need to transfer your personal data outside of your home country. By using our Service, you authorize us to transfer, store, use and process your data in the United States, and other countries outside of your home country. In some of the countries to which we transfer personal data, the privacy and data protection laws may vary from those of your home country.
